1. Definitions
In these Terms, the following capitalised terms have the meanings set out below. Other capitalised terms are defined where they first appear.
- "Company", "we", "us", "our"
- ZYON FOUNDATION, a Delaware corporation, operator of the Rented platform.
- "Platform" or "Rented"
- The Rented website, mobile experience, APIs, and related services through which Members list and rent clothing and accessories.
- "Member" or "User"
- Any person who registers an account on Rented, including Lenders and Renters.
- "Lender"
- A Member who lists an Item on the Platform for rent by other Members.
- "Renter"
- A Member who books or rents an Item from a Lender through the Platform.
- "Item"
- Any clothing, footwear, jewellery, bag, or accessory listed on the Platform for rental.
- "Listing"
- A Lender's published offer of an Item, including photos, description, price, availability, and declared replacement value.
- "Booking"
- A confirmed rental agreement between a Lender and a Renter for a defined Rental Period at an agreed price.
- "Rental Period"
- The dates between pickup/delivery and return specified in a Booking.
- "Service Fee"
- The 15% commission charged by the Company on the rental subtotal of each completed transaction. Covers payment processing and platform operations.
- "Protection Fee"
- A separate, non-refundable 3% fee charged to the Renter on the rental subtotal, shown as its own line at checkout. The Protection Fee funds the Self-Insured Protection Plan. It is not an insurance premium and the Company is not an insurer.
- "Security Deposit"
- A pre-authorisation hold placed on the Renter's payment method as collateral against damage, loss, or non-return.
- "Replacement Value"
- The honest, current market cost to replace an Item with one of equivalent brand, condition, and specification, as declared by the Lender.
- "Condition Report"
- The photo and written documentation of an Item's state, completed by both parties at handover and return.
- "Self-Insured Protection Plan"
- A discretionary, pooled internal fund operated by the Company and financed by the Protection Fee, used to compensate Lenders for verified losses beyond the Security Deposit, up to the applicable tier cap. It is a contractual damage-waiver and is not insurance.
- "Dispute"
- A formal claim raised by a Member through the Platform regarding damage, loss, late return, or other breach of these Terms.
- "Stripe"
- Stripe, Inc., the third-party payment processor used by the Company to handle payments, payouts, and Security Deposit holds.
- "Content"
- Any text, photos, reviews, ratings, or other material submitted to the Platform by a Member.
2. About Rented
Rented is a peer-to-peer clothing and accessories rental marketplace operated by ZYON FOUNDATION, a Delaware corporation. The platform enables users ("Members") to list personal wardrobe items for rent and to rent items from other Members.
3. Acceptance of Terms
By creating an account, browsing, or using Rented in any way, you agree to these Terms, our Privacy Policy, and all applicable laws.
4. Eligibility
You must be at least 18 years old to use Rented. By registering, you represent that you have the capacity to enter into a binding agreement.
5. Account Registration
You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Notify support@rented.live immediately if you suspect unauthorised access.
6. How Rented Works
Rented connects Lenders and Renters. The Company is not a party to the rental transaction itself — we facilitate the connection and handle payment processing.
- Lenders set their own prices, rental periods, and item descriptions.
- Renters browse, request, and pay for rentals through the platform.
- Rented charges a 15% service fee on each transaction.
7. Security Deposit & Protection System
Rented employs a multi-layered protection system to safeguard Lenders' items against damage, loss, and theft.
7.1 Security Deposit Hold
When a Renter books an item, a security deposit hold is placed via Stripe. This is an authorisation, not a charge.
- Amount based on declared replacement value and protection tier.
- Auto-released if both parties sign off the condition report.
- May be captured (partially or fully) for damage, loss, or non-return.
- Holds valid for the duration allowed by the card network (typically 7–30 days).
7.2 Protection Tiers

7.3 Self-Insured Protection Plan
A portion of the 15% service fee funds our Self-Insured Protection Plan, a pooled internal fund providing coverage beyond the deposit.
- Claims evaluated against documented condition reports.
- Approved claims paid up to the tier cap.
- This is not insurance — it is a discretionary benefit.
- Fraudulent claims result in immediate account termination.
7.4 Replacement Value Declaration
- Lenders must declare an honest replacement value when listing.
- Inflating values is prohibited and may result in suspension.
- Rented may adjust values that appear unreasonable.
8. Listing Items
When listing an item, you represent that:
- You own the item or have authorisation to rent it.
- The description and photos accurately represent its condition.
- The item is clean, undamaged, and safe to wear.
- The price is fair and clearly stated.
- You have declared an accurate replacement value.
9. Renting Items
As a Renter, you agree to:
- Treat rented items with reasonable care.
- Return items on time, in the condition received.
- Complete photo condition reports on receipt and return.
- Pay for damage beyond normal wear and tear.
9A. Cancellation, Late Return & No-Show Policy (Strict)
Ibiza runs on island time. Rented does not. Show up, send back on time, or pay.
Modeled on Airbnb's Strict and Super Strict 60-day policies, adapted for short-stay fashion rental. Both sides are held to the same standard of seriousness.
9A.1 Renter cancellations
- More than 7 days before pickup: full refund minus the non-refundable 15% service fee.
- 3 to 7 days before pickup: 50% refund of the rental subtotal; the service fee is not refunded.
- Less than 72 hours before pickup: non-refundable. The piece has been pulled from the calendar, prepared, and reserved for you alone.
- No-show / more than 2 hours late without written notice: 100% forfeit, plus an automatic €25 inconvenience credit paid to the Lender from the booking.
9A.2 Late return by Renter
- Up to 12 hours late: grace window — Lender notified, no penalty if returned with the piece in good condition.
- 12 to 48 hours late: automatic 1.5× the daily rate charged per additional day, deducted from the security deposit.
- More than 48 hours late, or returned damaged: the full security deposit is captured, Trust score drops, and a Strike is issued (3 Strikes = account suspension under Section 14).
9A.3 Lender cancellations (much harsher)
When a Lender cancels a confirmed booking, the Renter's Ibiza plan is broken. We treat this with the same seriousness as an Airbnb host cancelling on a guest.
- Cancellation more than 7 days before pickup: 100% Renter refund; Lender receives a written warning on file.
- Cancellation less than 7 days before pickup: 100% Renter refund, automatic €25 platform credit to the Renter, automatic 1-star service penalty on the Lender's profile, and a 14-day listing freeze on the affected piece.
- Lender no-show or item unavailable on pickup day: 100% Renter refund, €50 inconvenience credit to the Renter, Trust score penalty, and possible permanent removal of the listing.
- Three Lender-side cancellations within any rolling 90-day window: automatic account suspension pending Trust & Safety review.
9A.4 Praise for those who do well
- Reliable badge: 10+ completed rentals with zero cancellations and zero late returns — surfaces on your profile and unlocks a reduced service-fee tier.
- On-Time badge: 0 late returns over 90 days — surfaced on your listings and prioritised in search.
- Insider tier acceleration: clean cancellation history accelerates progression through the Insider Program (Section 12).
9A.5 Force majeure & exceptional circumstances
Documented illness, government-ordered restrictions, transport strikes affecting Ibiza and Formentera, severe weather warnings issued by AEMET, and bereavement may, at the Company's discretion, override the schedule above with a full refund and no penalty. Evidence is required.
9A.6 Consumer-law carve-outs
Nothing in this Section 9A removes the mandatory consumer rights you may have under Spanish Real Decreto Legislativo 1/2007 (TRLGDCU), Directive 2011/83/EU, Directive 93/13/EEC on unfair terms, or any equivalent law of your habitual residence. Note in particular that, under Article 16(l) of Directive 2011/83/EU, the 14-day right of withdrawal does not apply to services performed on a specified date or period — which is the case for every rental on Rented. Where a mandatory rule conflicts with this Section, the mandatory rule prevails for that user only, and the rest of this Section continues to apply.
10. Condition Reports & Disputes
Both parties must complete condition reports before and after each rental.
- Disputes must be raised within 48 hours of the rental end date.
- The Company will review documentation and decide within 5 business days.
- The Company's decision is final and binding.
11. Payments & Fees
- All payments processed securely through Stripe.
- Lenders receive 85% after the rental is completed and signed off.
- Refunds handled case-by-case via dispute resolution.
- Rented does not store credit card information.
12. Insider Status Program
The RENTED Insider Program is a non-monetary, status-based loyalty system that rewards trusted Members with increased visibility and platform perks. Tiers are computed automatically from rolling 90-day activity (rentals completed, average rating, response time, cancellation rate, condition-report compliance).
- Trusted, Insider, and Icon tiers grant search-ranking boosts of up to 1.5x and badge display on listings and profiles.
- Tier status is a discretionary benefit, not a contractual right. The Company may adjust thresholds, modify benefits, or revoke status at any time, including for policy violations, fraud, or chargeback activity.
- Status confers visibility only — it does not change Service Fees, payout rates, or the Self-Insured Protection Plan caps defined in Section 7.
- Manipulation of tier metrics (fake bookings, coordinated reviews, ranking manipulation) constitutes a material breach and results in tier removal and possible account termination.
13. Ambassador & Referral Program
Members may invite others using a unique referral code. Referral credits accrue to the inviter's Credit Ledger after the invitee completes a qualifying action.
- Renter referral: €20 in platform credit to both parties on the invitee's first completed booking.
- Lender referral: €50 in platform credit to both parties when the invitee completes their first paid rental as a Lender.
- Credits are platform-only currency, non-transferable, non-refundable, non-redeemable for cash, and expire 12 months after issuance.
- Anti-abuse cap: a Member may earn no more than €300 in referral credit per calendar month. Self-referrals, duplicate accounts, incentivised traffic, and bookings between related parties are prohibited and will be reversed.
- The Company may modify reward amounts, eligibility rules, or terminate the program with 30 days' notice. Pending unearned credits may be forfeited.
14. Featured Pages & Promoted Listings
Lenders may purchase optional promotional placements. All promoted content is clearly labelled and ranked alongside organic results in compliance with applicable consumer protection law.
- Featured Pages: category-specific landing pages with limited Hero and Grid slots sold on a weekly basis. Slots are non-refundable once the campaign window begins.
- Promoted Listings: available as flat-fee placements, daily-budget CPC, or pay-on-booking commission uplift (additional 3% on attributed bookings). The chosen mode is disclosed at purchase.
- Promotion does not guarantee bookings, sales, or specific impression volumes. The Company may pause, throttle, or reject any promotion that violates content standards or degrades user experience.
- Lenders remain solely responsible for the legality and accuracy of promoted Listings, including pricing, availability, and any advertising claims.
- Insider tier benefits and paid promotion are independent: paid promotion does not grant tier status, and tier status does not entitle a Member to free promotion.
15. Platform Credit & Ledger
Platform credits earned through referrals, promotional offers, or goodwill adjustments are tracked in the Member's Credit Ledger and applied automatically at checkout to eligible bookings.
- Credits apply only to the rental subtotal, not to Security Deposits or shipping.
- Credits cannot be combined with certain promotional discounts; the higher value applies.
- Credits are revoked if the underlying booking is cancelled, refunded, or charged back.
- Credits have no cash value and may not be sold, traded, or transferred.
15A. Coin Wallet (coins-v1)
Coins are single-purpose, non-refundable platform credit used to pay for AI-assisted services on Rented (e.g. Selecta outfit composition, Featured Page promotion). Coins are sold by ZYON FOUNDATION as digital content delivered immediately upon payment.
- 1 coin = €0.10. Sold in packs of 50 (€5), 200 (€18), and 500 (€40).
- VAT is calculated and remitted at point of sale via Stripe Tax (Spanish IVA 21% applies to EU consumers unless otherwise indicated).
- By purchasing, you expressly waive your 14-day right of withdrawal under EU Directive 2011/83/EU, Art. 16(m), as the digital content is delivered immediately at your request.
- Coins are not e-money, are not redeemable for cash, and may not be transferred between accounts or used to pay other Members directly.
- Coins do not expire while your account remains in good standing. They are forfeited on account termination for cause.
- AML safeguards: maximum €200 in top-ups per account per 24 hours; accounts younger than 24 hours cannot top up.
- Selecta spins, once the feature exits beta, will cost 1 coin per composition.
- Disputed top-ups are handled through Stripe; refunds are at our sole discretion and only granted in cases of duplicate or fraudulent charge.
16. Prohibited Conduct
You agree NOT to:
- Use the platform for any illegal purpose.
- List counterfeit, stolen, or hazardous items.
- Circumvent the platform for private transactions.
- Harass, abuse, or threaten other Members.
- Create multiple accounts or impersonate another person.
- Manipulate reviews, ratings, or condition reports.
17. Intellectual Property
All content on Rented — logos, text, design, software — is the property of ZYON FOUNDATION or its licensors. You may not copy, modify, or distribute platform content without written permission.
By listing an item, you grant Rented a non-exclusive, worldwide licence to use your photos and descriptions to operate and promote the platform.
18. Marketplace Facilitator Status
Rented is a marketplace facilitator. We are not a party to the rental agreement between Lender and Renter and are not responsible for the quality, safety, or legality of items listed by Members. See Sections 22–24 below for the non-compete, dispute-resolution, and liability terms that govern your use of the Platform.
19. Indemnification
You agree to indemnify and hold harmless ZYON FOUNDATION from any claims, damages, losses, or expenses arising from your use of the platform or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
20. Governing Law & Forum
These Terms are governed by the laws of the State of Delaware, USA, and any proceedings shall be brought in the state or federal courts located in Delaware, except that consumers domiciled in the European Union, the European Economic Area, the United Kingdom or Switzerland retain the right to bring proceedings in the courts of their country of habitual residence and to rely on the mandatory consumer-protection rules of that jurisdiction (Brussels Ia Regulation 1215/2012, art. 18; Rome I Regulation 593/2008, art. 6).

22. Non-Compete (Lenders, Ambassadors & Contractors only)
This Section does not apply to Renters acting as consumers. It applies only to (a) Members operating as commercial Lenders (i.e. listing items as part of a trade, business, craft or profession), (b) Members enrolled in the RENTED Ambassador or affiliate-recruitment programs, and (c) paid contractors, advisors and employees of Zyon Foundation.
- Scope: peer-to-peer rental of clothing, footwear, jewellery, bags and accessories, in the Balearic Islands.
- Duration: for as long as the Member is engaged with RENTED, and for twelve (12) months after the engagement ends.
- Restricted activity: launching, operating, owning more than 5% of, or actively promoting a directly competing peer-to-peer fashion-rental marketplace in the geographic scope above.
- What is permitted: renting from or lending on other platforms as an end user; working in fashion retail, bricks-and-mortar rental, styling, manufacturing or any unrelated industry; ordinary employment that does not breach the restricted-activity definition.
- Severability / blue-pencil: if any court finds the duration, geographic scope, or activity scope above unenforceable, that element shall be reduced to the maximum extent permitted by the law of the Member's habitual residence, and the remainder shall continue in force.
- Consumer carve-out: nothing in this Section restricts a Renter acting outside their trade, business, craft or profession, and nothing in this Section is intended to be enforceable to the extent prohibited by Article 86 of the Spanish TRLGDCU, the EU Unfair Terms Directive 93/13/EEC, or any equivalent mandatory consumer-protection law applicable to the Member.
23. Dispute Resolution, Arbitration & Class-Action Waiver
23.1 Informal resolution. Before filing any formal claim, you agree to first contact us at support@rented.live and give us 30 days to resolve the issue.
23.2 Binding arbitration (US Members). If you are domiciled in the United States, any dispute arising out of or relating to these Terms or the Platform shall be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in Wilmington, Delaware. The arbitrator may award the same damages and relief that a court could award.
23.3 Class-action waiver. To the maximum extent permitted by law, you and the Company each waive the right to participate as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding, and agree that disputes shall be resolved on an individual basis.
23.4 EU / UK / Swiss consumer carve-out. The waiver in §23.3 and the arbitration requirement in §23.2 do not apply where you are a consumer resident in the EU, EEA, UK or Switzerland and the law of your habitual residence guarantees a right to representative or collective redress (including under EU Directive 2020/1828 on representative actions and Spanish Law 1/2025). Those rights, and your right to seize the courts of your country of habitual residence under Brussels Ia Reg. 1215/2012 art. 18, are preserved.
24. Limitation of Liability & "AS IS" Service
24.1 AS-IS. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory or otherwise, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement, or that the Platform will be uninterrupted, secure, or error-free.
24.2 Liability cap. To the maximum extent permitted by applicable law, the aggregate liability of ZYON FOUNDATION and its affiliates, officers, directors, employees and agents arising out of or relating to these Terms or the Platform is limited to one hundred US dollars (USD $100) per Member per twelve-month period.
24.3 Mandatory carve-outs. Nothing in §24.1 or §24.2 limits or excludes liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence or willful misconduct; (d) any liability that cannot be excluded or limited under the law of the Member's country of habitual residence (including statutory consumer warranties under EU Directive 2011/83, Directive 2019/771, the Spanish TRLGDCU, the UK Consumer Rights Act 2015, and equivalent regimes); or (e) amounts payable under the Self-Insured Protection Plan as defined in Section 7.
24.4 Statutory rights. The statutory rights of consumers under EU, UK, Swiss and Spanish law are not affected by these Terms.
24.5 Indirect damages. To the maximum extent permitted by law, and subject to §24.3 above, the Company shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, or goodwill.
25. Founders 50 Addendum ("The Queens")
25.1 Scope. This addendum applies only to the first fifty (50) Members enrolled in the Founders 50 program (each, a "Queen"). Enrolment is capped at 50 seats, requires identity verification (KYC), and is recorded with an addendum version of founders50-v1 in the TOS acceptance log.
25.2 Elevated economics. For 12 months from enrolment, a Queen earns €75 per qualified first-rental referral (vs €50 standard), capped at €500/month (vs €300 standard). After 12 months, the standard schedule applies. The platform fee, payout mechanics and Stripe Connect terms are unchanged.
25.3 Non-compete. Each Queen re-affirms Section 22 (12-month Balearic Islands peer-to-peer fashion rental non-compete for Lenders & Ambassadors).
25.4 Truth in advertising. Any public post, story, reel or message by a Queen that mentions earnings, income, returns or platform performance must include the disclosure "results not typical" or substantively equivalent language, in compliance with the FTC Endorsement Guides (16 CFR Part 255) and EU Directive 2005/29/EC (Unfair Commercial Practices). Material connection to Rented must be disclosed (e.g. #ad or #partner).
25.5 Gifting & benefits. The Digital Gold Tag profile badge and annual founders' dinner are non-transferable benefits with nominal monetary value and do not constitute compensation for services. The Digital Gold Tag is a profile-only credential; no physical merchandise is shipped. Queens are independent users, not employees or agents of ZYON FOUNDATION.
25.6 Revocation. Status may be paused or revoked by the Company for material breach of these Terms or the Acceptable Use Policy, with notice and a 7-day cure period where the breach is curable. Revocation forfeits the elevated schedule prospectively but does not claw back amounts already earned.
25.7 No multi-level recruitment. Rewards are paid only on direct, first-line referrals. There are no downline tiers and no bonuses for recruiting other Queens or Ambassadors.
25.8 Consumer rights. Sections 23 (class-action carve-out) and 24 (liability cap and statutory carve-outs) apply to this addendum without modification. Nothing here limits a Queen's mandatory consumer rights under EU, UK, Swiss or Spanish law.

11. Radio Rented.Live — Music & Station
11.1 Ownership. All music, jingles, commercials, station IDs, interviews and audio content broadcast on Radio Rented.Live is owned, produced, or fully licensed by Zyon Foundation Music, a division of Zyon Foundation. All copyrights, master and publishing rights belong to the Foundation. No external or third-party copyrighted music is broadcast.
11.2 Listening licence. The station is provided free of charge for personal, non-commercial streaming inside the Rented platform. You may not rebroadcast, record, re-upload, or use the stream in any public venue, event, or commercial context without prior written permission from Zyon Foundation Music.
11.3 Single-track purchases (€2 per song). Purchasable tracks may be acquired for €2.00 (or the equivalent in platform coins — 20 coins per track) via Stripe Checkout with VAT handled automatically by Stripe Tax. A purchase grants a personal, non-exclusive, non-transferable licence to download and listen to one (1) audio file for personal use. Resale, redistribution, sync use, sampling, public performance and inclusion in derivative works are not permitted without a separate written licence.
11.4 Playlist bundles. When you buy multiple tracks from one Vibe Jukebox playlist, the platform may apply tiered discounts (10% from 4 tracks, 20% from 8, 30% from 15). Bundle pricing is informational only until explicitly confirmed at checkout.
11.5 Digital goods — withdrawal. Because each downloaded track is a digital good delivered immediately on purchase, you expressly waive your 14-day EU right of withdrawal at the point of payment. Purchases are final and non-refundable except where the file cannot be delivered or is materially defective.
11.6 Early-access signups. If you submit an email or phone number to receive new drops, you consent to marketing communications from Zyon Foundation Music. You may unsubscribe at any time.
11.7 Sponsorship & ads. The station may rotate branded jingles and sponsor spots. Sponsors do not own user data and cannot contact you directly through the platform.
11.8 Takedown. If you believe any audio on Radio Rented.Live infringes your rights, contact rights@rented.live with proof of ownership; we will remove or replace the asset within 72 hours pending review.
12. Kids & Family — Family Rentals Addendum
12.1 Scope. This addendum applies to any listing where audience = "kids" — clothing, footwear, swimwear, baby gear (strollers, car seats, travel cots, high chairs, carriers), beach and pool kit, toys, scooters and bikes, and maternity / nursing items. The general Terms apply in full; this addendum adds family-specific obligations.
12.2 Lender obligations. Every Kids & Family lender must (a) pass the same KYC as women's wardrobe lenders, (b) pledge to clean, wipe-down or freshly launder each item before every booking ("sanitisation pledge"), (c) for baby gear, provide a manufacturer-stamped safety-expiry date and confirm no open recall affects the item, and (d) keep car seats and strollers within their listed expiry window. Items past expiry are auto-hidden from search.
12.3 Renter obligations. Renters are solely responsible for the correct installation, fastening, supervision and age-appropriate use of any item listed for a child. Rented and the lender do not supervise children at any time. Renters must immediately notify the lender of any damage, soiling beyond normal wear, or any incident that may affect the safety of the item for the next family.
12.4 No medical / no childcare service. Rented does not provide childcare, medical advice, or product-safety certification. Items are peer property; lenders are private individuals, not regulated baby-equipment retailers. No warranty of fitness for any particular child or use is given beyond the lender's good-faith pledge.
12.5 Hygiene incidents. If an item is returned visibly soiled, biologically contaminated, or unsafe for the next renter, the lender may capture the full security deposit toward professional cleaning or replacement, and Rented may apply a Strike under the Acceptable Use Policy.
12.6 Age-appropriate filters. Listings carry an age band(0–3m through 8–12y). Renters represent that any item rented matches the actual age, weight and developmental stage of the child for whom it is intended.
12.7 Mandatory carve-outs. Nothing in this addendum limits the consumer rights of EU, UK, Swiss or Spanish residents, nor any non-waivable rights of children under applicable law.
